Terms of use

Site shall mean a set of electronic documents (files) posted on the Internet, united by a single theme, design and single address domain space myuniver.org. The home page of the Site is available on the Internet at https://myuniver.org/en

User of the Site (User) shall mean an individual of full age who accesses the Site and/or uses and/or used it. 

The Site Administration (Administration) shall mean Limited Liability Company "MYUNIVER" registered in accordance with the current legislation of the Republic of Belarus (UNP (Payer's Identification Number) 193287288, legal address: 38-11 Novovilenskaya Str., Minsk) that owns all relevant property rights to the Site, including the rights to the domain name of the Site, and administers it. 

2.1. These Terms and conditions agreement (hereinafter - the Agreement) is executed by and between the Limited Liability Company "MYUNIVER" and any person intending to use and/or using the website https://myuniver.org/en.

2.2. The text of this Agreement is the Administration's offer for the public containing the Administration's proposal to enter into an agreement with each User regulating the following aspects of the relationship between the Administration and the User when using the Site under the terms and conditions specified herein.

2.3. The acceptance of this offer as per clause 3 of article 408 of the Civil Code of the Republic of Belarus shall be any use of the Site by the User, including the first opening of any page of the Site in the browser on any device of the User.

2.4. The User gives its consent to process personal data according to the rules of section 6 of this Agreement, and according to the Law of the Republic of Belarus dated May 7, 2021 N 99-3 “On Personal Data Protection”, by ticking the box in the appropriate field when using the online application form.

2.5. The Site using, including its view, information retrieval, use of services (hereinafter - the Site using) is possible only subject to full and unconditional acceptance of the offer (acceptance) in the form established by this Agreement.

2.6. If disagreed with the terms and conditions of this Agreement, the User shall cease to use the Site immediately.

3.1. Under this Agreement, the Administration shall grant a non-exclusive license to the User to use the Site free of charge. The Site is a composite (complex) object of intellectual property within computer programs and other software, databases, visual content and other works combined to ensure the smooth operation of the Site and the use of its capabilities.

3.2. The Users shall use the Site for personal purposes, not related to making profit, to search for educational programs of the first and second levels of education, language courses and pre-university training and to apply for admission to a specifically selected training program or to a specific educational institution.

3.3. If it is necessary to use the capabilities of the Site for business purposes (i.e. to publish information about educational services provided by the User, and to ensure the receipt of applications from other Users for the provision of such services for profit), the User shall enter into a separate agreement with the Administration.

3.4. The Administration's services for enabling the Users to submit an application and documents for enrolment and execution of the paid educational services contract shall be rendered free of charge.

3.5. The Administration is not an educational institution and does not render any educational services.

4.1. The Site is a guide for searching for educational programs of the first and second levels of education, pre-university training, language courses, tuition fees, terms of study, educational institutions. 

4.2. The Administration obtains information on educational programs published on the Site directly from the educational institutions. The Administration shall take measures to verify this information and eliminate misinformation as well as the information the publication of which has not been approved by the educational institution. 

4.3. The Administration shall take all reasonable measures to verify the information provided by educational institutions for its publication on the Site. Moreover, the Administration shall not regularly verify this information as to its relevance. 

4.4. The Administration shall rate the educational institutions based on the criteria established by the Administration. The Administration shall not inform Users of the principles and criteria for determination of the rating of educational institutions, although it has the right to do so, wholly or partially. 

5.1. The Administration owns exclusive rights to the Site, including exclusive rights to any results of intellectual activity contained in it, including program code, databases posted on the Site (information about educational institutions and training programs of the first and second levels of education, pre-university training, language courses), designs, texts, as well as means of individualization (brand name, trademarks, service marks, commercial designations). The Site using does not provide for the transfer of rights to the Site or its components. The User is granted a limited right to use the Site under the Agreement. Such right may be terminated at any time under the terms and conditions of this Agreement and other agreements between the parties.

5.2. The User shall not use the results of intellectual activity posted on the Site (including, but not limited to: images, texts, program code) without prior written consent of the Administration.

5.3. All services of the Site shall be provided free of charge and in "as is" condition. The Administration does not guarantee the continuous availability of the Site. The Administration shall be entitled at any time to refuse any User's use of the Site in case of violation of the Rules.

5.4. The User shall not be entitled to request any changes to the services or data of the Site.

The Administration shall not be liable for merchantability of the Site, does not guarantee the compliance of the Site with specific requirements of Users or customization capability of the Site sections according to Users preferences, as well as it does not guarantee that the software of the Site is completely free of defects and errors and must operate smoothly and without fail.

5.5. The User shall use the Site solely at its own risk. The Administration does not guarantee smooth operation of the Site and shall not be liable for damage caused to the User as a result of Site using. The Administration is obliged to take legal, organizational and technical measures to ensure the protection of personal data from unauthorized or accidental access to them, modification, blocking, copying, distribution, provision, deletion of personal data, as well as from other illegal actions in relation to personal data.

5.6. The Administration shall make every reasonable effort to prevent malfunctions of the Site, but it does not guarantee its smooth operation, shall not be liable for it and shall not notify the Users of malfunctions.

5.7. The User may not use the Site for mailing  advertisement messages and other actions that are not directly related to the Site using. The User may not use the program code of the Site, any Site content (including, but not limited to: databases, text, design elements, graphics) without prior written consent of the Administration (including reproduce, copy, process, distribute in any form).

6.1. The User gives his consent to actions or a set of actions performed with Personal Data using automation tools or without using such means, including collection, systematization, storage, modification, use, distribution, provision, including cross-border transfer, depersonalization, blocking, deletion.

6.2. The User allows to collect, store and process this information as well as to provide it to the educational institution to which the user applies for the provision of paid educational services.

6.3. The Administration shall take measures to protect confidential information obtained from Users, and shall not disclose it to third parties unless otherwise stipulated by this Agreement or the legislation.

The Administration may use industry-wide "cookies" technology (cookies). Cookies are a small packet of data sent by a web server and kept on a computer used by the Site User that allows the Administration to save personal settings and preferences of the User, as well as to collect its non-personal information. The use of "cookies" technology is carried out in accordance with the Administrator's Cookie Policy.

6.5. The Administration may use the received personal data for the purposes defined by the Personal Data Processing Policy. 

7.1. The Administration shall under no circumstances be liable for the quality of educational services provided by educational institutions, including those whose profiles are posted on the Site.

8.1. This Agreement shall be valid for the entire period of the Site using by the User.

8.2. The Administration may at any time alter the terms of the Agreement by publishing its revised version on the Site. The current version of the Agreement is published on the Site at https://myuniver.org/en/terms and becomes binding on the User from the date of publication. The User shall regularly review the text of the Agreement published on the Site in order to review the changes.
